Please read these Terms & Conditions carefully before using EB Holding SA services. By using them, you agree to be subject to these conditions.

1. INTELLECTUAL PROPERTY, COPYRIGHT AND PROTECTION OF DATABASES

All the content present on this page or made available through EB Holding SA services, such as text, graphics, logos, buttons and images, is the property of EB Holding SA, its affiliates or its content providers and is protected by Swiss and international intellectual property, copyright and database protection law. The compilation of all content present or made available through the services of EB Holding SA is the exclusive property of EB Holding SA and is protected by Swiss and international intellectual property and database protection law.

You must not systematically extract and / or reuse any parts of the content from any EB Holding SA service without our written permission. In particular, you must not use a data suction robot, or any other similar data collection or extraction tools to extract (in one or more times) and reuse a substantial part of any service offered by EB Holding SA without our express written agreement. The brands and visuals of EB Holding SA may not be used for products or services that do not belong to EB Holding SA or that could cause confusion in any way among customers and disparage or discredit EB Holding SA. All other brands that do not belong to EB Holding SA and that appear on any EB Holding SA services are the property of their respective owners.

3. YOUR ACCOUNT

If you use any of the services of EB Holding SA, you are responsible for maintaining the confidentiality of your account and password and for upholding restrictions on access to your computer. You also agree to be responsible for all activities that have been carried out from your account or with your password and within the limits of what is authorized by applicable law. These general terms of use are subject to the Swiss law, and the application of the Vienna Convention on contracts for the international sales of goods is excluded. We have agreed to submitting all disputes arising from the commercial relationship between us and our customers to the exclusive jurisdiction of the Canton of Vaud in Switzerland which means that for the application of these conditions of use, you can take legal action to assert your consumer rights in Switzerland.

6. MODIFICATION OF SERVICES OR TERMS OF USE

We reserve the right to make changes to EB Holding SA services, procedures, terms and conditions including these terms of use at any time. You are subject to the terms and conditions, procedures and terms of use at the time you are using one of EB Holding SA services. If a stipulation of these terms of use is deemed invalid, void, or inapplicable for whatever reason, this stipulation will be deemed divisible and will not affect the validity and enforceability of the remaining stipulations.

7. WAIVER

If you violate these terms of use and we take no action, we will still be entitled to use our rights and remedies in all other situations these terms of use have been violated.

TERMS OF SALE

These Terms of Sale govern the sales of all products between EB Holding SA and its customers.

Please read these conditions carefully before placing an order with EB Holding SA. By ordering from EB Holding SA you agree to these terms & conditions.

1. OUR CONTRACT

After placing your order, we will send you an e-mail confirming that we have received it. We will inform you once your order has been sent.

Please note that we only sell products in quantities corresponding to the usual average needs. This applies to the number of products ordered in a single order as much as to the number of individual orders respecting the usual quantity of a normal household placed for the same product.

2. RETURN & EXCHANGE

Orders are non-refundable and cannot be exchanged.

The Return and Exchange policy is indicated on the website.

3. PRICES AND AVAILABILITY

All the prices are indicated including the Swiss VAT which will be deduced for deliveries outside Switzerland and the Principality of Liechtenstein.

We display the availability of our products on each product sheet of the website. We cannot provide additional details regarding the availability of products than what is already displayed. When processing your order, we will notify you by email as soon as possible if any products you have ordered turn out to be unavailable, and we will not charge you for these products.

Despite our best efforts, a small number of the products in our catalogs may display an error in the price. We will check the price when processing your order and before any payment. If it turns out that we have made an error, and that the real price is higher than the price displayed on the website, we will contact you to ask if you want to buy the product at its real price or if you prefer to cancel your order. If the actual price is lower than the displayed price, we will charge you the lowest amount and send the product to you.

4. CUSTOMS

When you order products to be delivered outside of Switzerland and the Principality of Liechtenstein, you may be subject to importation taxes, which are levied when the package arrives at its destination. Any customs clearance fees will be at your expense; we have no control over these charges. Customs policies vary widely from country to country, so you should contact the local customs services for more information. In addition, please note that when you place an order, you are considered the official importer and must comply with all the laws and regulations of the country in which you receive the products. Protecting your privacy is important to us and we draw the attention of our international customers to the fact that cross-border deliveries are likely to be opened and inspected by customs authorities. 5. OUR RESPONSIBILITY

We are committed to providing you with all the usage guidelines in the profession for the proper implementation of the service offered to the client. However, our responsibility cannot be retained in the event of delay or breach of our contractual obligations if the delay or breach is due to a cause beyond our control: fortuitous event or force majeure as defined by applicable law.

Our responsibility will not be induced in case of minor differences between the delivered products and the photos and texts posted on the website.

We use all means possible to provide the services covered by these Terms of Sale. We are responsible for any direct and foreseeable damage during the use of the website or the conclusion of the sales contract between us and our customers.

The limitation of liability referred to above is inapplicable in the event of fraud or gross negligence on our part, in the event of physical injury or liability for defective products and in the event of non-compliance (including due to hidden defects).
